I really do hate to play devil’s advocate for Obama, as he’s done some unequivocally terrible things lately, but I think there is something to the argument that he wants to get health care done first before moving on to other domestic issues.

Not that that’s being handled wonderfully either, mind, with everyone still terrified that he’s going to skip out on another promise and water down the public option.

Personally, I think the whole notion of “political capital” is obsolete with the current batshit insane GOP that will say and do whatever it wants, regardless of “reality” and “facts” and “what people actually said”. But if he thinks delaying other reforms will help him pass a better health care plan, that might be the case.

And they go so far as even extending past religious right claims to try and make same-sex marriage seem bad for the federal budget? This sounds like it was written by a Scalia acolyte, not an administration reluctantly having to uphold a law it finds distasteful.

If I’m driving down the road and someone cuts me off, and I retaliate by running them off into a ditch, I can’t blame them for my reaction. I CHOSE to react that way.

Turnout was massive and could break records. It’s legal S.O.P. – the lawyer for the respondent almost always files a motion for summary dismissal. It means, “Your honor, take a look at this case and just decide the plaintiff can’t win, so you won’t waste the court’s time.”

If a lawyer didn’t file a motion for summary dismissal, that lawyer would be considered seriously inept. It’s automatic, so to speak. However, almost all such motions are denied, unless the case is idiotically frivolous.

Look, the US attorney in the case must do his or her level best to win the case, or frankly, he or she is committing malpractice. In this case, “winning” means letting the lower court (California SC) ruling stand.

Obama and his administration are DA MAN now. There’s going to be cases where the Obama Justice Department has no real choice but to be DA MAN. It’s the adversarial nature of US legal system. So when someone brings a case against the US Government, the Obama Administration, being the current embodiment of that Government, must take the opposing side.

We saw this happen when California AG Jerry Brown first argued against the lawsuit to declare same-sex marriage constitutional. Regardless of Brown’s personal opinion, his office had the duty to argue the State’s case. Then, after Prop 8 and the case went back to the Court, the AG’s office argued exactly the opposite, a case that was driven by Brown himself. That’s just the way the system works.

We leave it up to you guys at Lambda to figure out the lines of argument that will succeed.”

It’s just real tough to get a read on what the attorneys intended–which marks them as tremendously capable. Absence of evidence isn’t evidence of absence, of course, and this may be purest wishful thinking on my part, but they may be telegraphing how to argue in favor of gay marriage.

I’ve gotten the sense that Obama is really big on procedure. I don’t know what I think of this — is this tone-deafness or legal principle? I really don’t know. IF that’s what it is (and it’s defensible from that perspective, even if it’s not correct), it’s ugly but understandable.

That said, the brief was evidently written by a Mormon Bushie and shouldn’t have been released in that form, and Holder at the very least owes the GLBT community an apology for letting such an inflammatory piece of horseshit get out on his watch. Ideally I’d love to see it handled in a manner akin to the flap over the Special Olympics. (I dropped an email to president@whitehouse.gov (for all the good that’ll probably do) and cc’ed it to my congresscritter.)

Happens on Facebook. Sometimes I put a political post on there, some pithy epigrammatic sort of thing, and suddenly there’s a pissing contest and the whole “Gramma’s pictures of the babies” aspect of Facebook is gone, and there’s this back-and-forth that looks like what people were getting into right before the Civil War, instead.

This country is just barely keeping itself together, I’m starting to realize. If the left has to get militant again, the right is going to start shooting, and we’ll have chaos.

Kind of a buzzkill in some ways.

What sweats me is the likelihood of a wave of violence actually occurring, because those fuckers can deny, ridicule, and dismiss, as is their habit, but there are hundreds of thousands of heavily-armed, completely insane assholes out there, and they’re only waiting for the slightest whiff of civil unrest to go out and shoot them some vegetarians/ fags/ colored folk.

I’m a gun-friendly person myself, on a much smaller, left-wing, “it’s okay to make people pass some rudimentary suitability test before they shoot things” kind of scale, so I venture, hobbit-like, into the depths of gun Mordor on occasion. You go to any of the gun forums on the Interwebbing, you will find about 50% of the comments have some reference to: 1) the need to kill for FREEDOM, 2) Barry X. Husssein’s tyranny coming to an end so abrupt that he’s already on the floor when the report is heard from the belltower, and 3) the big Peckinpah style showdown which is imminent.

These people have big, crazy plans.

Then consider the outrage from the right over the DHS report on right-wing extremism. It ‘insulted’ veterans, pro-lifers etc. … of course, the only real insult in the warning to law enforcement officials was to the law enforcement officials themselves, who are apparently too dumb to look at the current situation (black Democratic president, shattered economy, vets returning from the most traumatic charnel house since Vietnam, etc.) and figure out that they might want to be on the look out for right-wing nutters lashing out.

I joke about the report being an insult to law enforcement, of course. But I do wonder at the surprise some people exhibit when stuff like the Tiller murder or the Holocaust Museum shooting happen … haven’t they been, you know, observing events in the world? It’s like the Ryan Report or the Boston Archdiocese scandal — there are always people gobsmacked at revelations that Catholic priests abused the children in their care, as if this hasn’t been known since the fucking papacy was in Avignon, or you know, the First Council of Nicaea.
