A somewhat-more-with-it correspondent has tried to point out to them that all an investigation will reveal is that they made fake donations to the campaign under funny names. But they’re just ignoring him.

(1) Andy is citing as reliable the plaintiff, Philip J. Berg, whose other ongoing cause celebre is a lawsuit filed against Bush and Cheney for killing 3,000 people on 9/11. http://www.scoop.co.nz/stories/WO0701/S00076.htm. Yes, Andy’s derangement has reduced him to looking to the 9/11 Truthers for election hope.

(2) The lawsuit against Obama alleges that (a) Obama was born in Kenya to his American mother (so he was still a U.S. citizen), but she hatched a crazy plan to make it appear like he was born in Hawaii to preserve his presidential eligibility; and (b) his mother then moved to Indonesia and took actions rescinding Obama’s U.S. citizenship. Andy faults the Obama campaign for failing to call a press conference to “simply [clear] up any questions — which you would think would take about five minutes” I can’t imagine why.

(3) Andy, who claims to have previously been an assistant U.S. attorney, mixes up basic concepts of civil procedure. Berg filed the lawsuit and then served 40+ Requests for Admission asking Obama to admit or deny claims such as he renounced his citizenship while a child in Indonesia and that he was not born in Hawaii. Obama’s attorneys filed a motion to dismiss the lawsuit correctly noting that individuals do not have standing to sue to have a presidential candidate declared ineligible. Obama’s attorneys also filed a motion to stay discovery including the need to respond to the requests for admission.

Before the judge ruled on these motions, Berg yesterday filed a motion to deem the requests admitted and issued a press release announcing that 30 days had passed without Obama answering, so they are all deemed to be admitted. Needless to say, the odds of the judge issuing an order consistent with the press release is zero. But Andy flunks basic reading as his post indicates that Obama “failed to file a timely answer [to the lawsuit], meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg’s allegations that he is constitutionally ineligible to be president.” No mildly competent attorney would draw such a conclusion or even treat it as plausible.

But, hey, maybe Andy has hit on an awesome new legal campaign strategy. I bet if Andy successfully urged every Republican nationwide to file a copycat lawsuit and discovery request against Obama, Obama would be bound to default on one of the lawsuits since there is no way Obama’s legal team could answer millions of lawsuits in one week. So, by legal default, Obama would be declared ineligible by default and McCain would win as the last man standing. Yeah Democracy!

And at the risk of being a Word Nazi, I once again must wonder if these dumb fucks know how to use a dictionary.
